Thailand Finalizes Rules for Crypto ETFs
Written by Felix Ng, staff editor, and edited by Yohan Yun, staff editor.
Thailand’s Securities and Exchange Commission (SEC) has finalized rules enabling crypto exchange-traded funds (ETFs) to list on the Stock Exchange of Thailand (SET), with Bitcoin and Ether initially permitted. The regulations will come into effect on October 16, 2026.
Key Points:
- Crypto ETFs must trade exclusively on the SET.
- Products linked to foreign crypto ETFs, such as depositary receipts, are initially prohibited.
- Thai brokers remain restricted from facilitating retail investments in overseas crypto ETFs for all but institutional and ultra-high-net-worth investors.
- Binance Thailand CEO Nirun Fuwattananukul notes that ETFs can remove barriers for cautious investors.
- Mutual funds and private funds can now invest in Thai-established crypto ETFs, a change from previous regulations that limited investment to foreign ETFs.
The framework offers Thai investors direct access to Bitcoin and Ether through the stock market, subject to certain conditions:
- Competitive fees
- Tight tracking of underlying assets
- Investor education
Issuers must complete registration, obtain approval, secure a SET listing, and arrange custody before launching their crypto ETFs. The SEC consulted with stakeholders during April and May, and received mostly supportive feedback regarding the proposed principles.
